‘Cancellation Clause’ incorporated in appointment orders

JAMMU, Dec 4: In a significant decision, the Government of Jammu and Kashmir has ordered for inclusion of `Cancellation Clause’ in the appointment orders of new recruits if the selected candidate fails to join within stipulated period of 21 days.
All the Administrative Secretaries have been impressed upon to, henceforth, incorporate the Cancellation Clause as a standard condition in all the appointment order as may be issued by their departments or their Heads of Department or subordinate officers.
As per the circular in this regard, there shall be a standard condition in all the appointment orders to be issued by the departments, which reads; “The candidates who fail to join within a period of 21 days from the date of issuance of the appointment order shall forego their right to appointment, which shall be deemed to have been cancelled abinitio without any further notice.”
According to the Government, the inclusion of `Cancellation Clause’ was necessitated to avoid difficulties in computation of vacancies and avoidable litigations.
