CAT quashes suspension of police officer

JAMMU, Oct 14: The Central Administrative Tribunal (CAT), Jammu Bench has quashed the suspension of Ramesh Kumar Bhat, a senior Police Officer of J&K Cadre.
The order has been passed by the Division Bench comprising Rajinder Dogra, Judicial Member and Ram Mohan Johri, Administrative Member. The CAT directed the Government to issue integrity certificate in favour of the applicant in service in pursuance of the selection by selection committee, which met on 29.07.2021 and 21.07.2023.
“The Government should go ahead for the induction of the applicant into IPS services for the select year 2012-13 and for the selection of year 2015 at the appropriate place as per his seniority in 1999 batch of JKPS. One post of IPS from the AGMUT shall be reserved for him as per order dated 22.12.2023 passed by this Court”, the CAT said and directed that this process shall be completed within a period of four weeks.
As per the facts of the case, the applicant was promoted as Superintendent of Police with effect from 2005 and thereafter respondents initiated the process of preparation of selection list for the promotion of Superintendent of Police to IPS of AGMUT Cadre.
The applicant was considered for the induction for 2010-2013 but due to FIR registered against him for sexual harassment which was filed by a lady against him while he was conducting the enquiry he was not considered for the promotion.
The applicant stated that he is under suspension since last three years and neither any chargesheet has been served upon him nor any enquiry initiated against him. Also, he was not considered for promotion and he is going to be retire within a period of one year.
“A person cannot be kept under suspension for immemorial time and if there is no charge sheet and no enquiry has been conducted against the person, it deserves to be quashed and he should be considered for the promotion”, the CAT said.
