CAT stays reversion of 98 Physical Education Masters

JAMMU, June 23: The Central Administrative Tribunal (CAT) today stayed the order of reversion of 98 Incharge Physical Masters.
The order has been passed in a petition filed by Jatinder Singh and others in which Senior Advocate Abhinav Sharma submitted that the applicants joined the respondents as Physical Education Teachers in the year 2011 and thereafter to become eligible for promotion to the post of Physical Education Masters, they wanted to get the higher qualification of BP.Ed Degree.
They applied for and the Director, Youth Services and Sports Department granted them permission to pursue the course and based on this permission they acquired the higher qualification and became eligible for promotion as Physical Education Masters. While some of the applicants were considered by the DPC for promotion as Physical Education Masters, however, the cases of the rest of the applicants were not considered.
When they represented this issue, subsequently they were also considered by the DPC for promotion as Physical Education Masters. However, the respondents have not issued their promotion orders contending that they did not obtain the permission of the competent authority, for undergoing the course.
After hearing Senior Advocate Abhinav Sharma in length, CAT issued notice to the respondents which was accepted by Deputy AG Rajesh Thappa and directed the respondents not to give effect to their order dated 28.04.2022 for the applicants.
