JAMMU, Sept 4: The Central Administrative Tribunal (CAT), Jammu Bench has stopped salary of the Chief Engineer, Public Health Engineering Department for non-compliance of the orders.

The order in this regard has been passed by the Judicial Member Rajinder Dogra, who took serious note of the fact that official has neither filed the reply nor he bothered to appear virtually before the court to explain why the reply was not filed till date.
The Public Health Engineering Department has been granted sufficient time to file reply in the case titled “Rakesh Kumar Versus Department of Jal Shakti” but there was non-compliance. “This court cannot act as a mute spectator and permit such approach of the department towards the court’s order”, Judicial Member said, adding “the law must prevail and we have to hold the majesty of court.
The aggrieved person had filed a case in the year 2021 against the Public Health Engineering Department but the department being lethargic over the matter failed to file the reply despite availing various opportunities vide orders dated 14.12.2023, 01.04.2024, 07.06.2024, 13.06.2024 and 30.07.2024.
“This shows callous attitude and taking orders of the court very casually. So, in the facts and circumstances, the court has been compelled to pass adverse orders against the official who have been adopting sluggish approach towards the orders”, Judicial Member said.
The CAT has directed Commissioner Secretary, Public Health Engineering Department to hold the enquiry against the official and take the action as per the Conduct Rules for not obeying the orders of the court.
