CB failure leads to acquittal in DoB forging case

JAMMU, Feb 21: CJM Jammu, S C Katal has acquitted one Goverdhan Singh, the then ASI, who was booked for forging date of birth as Crime Branch failed to prove its case.
After hearing Advocate Rajinder Singh Jamwal for the accused whereas CPO for the State, the court observed, “one of witness who collected the record from the school is an important witness and non-examination of such witness is fatal to prosecution case”, adding “in criminal case it is the duty of the prosecution to prove their case beyond shadow of doubt. No evidence is available in record to prove that accused collected the school leaving certificate and tempered. Hence benefit of doubt goes to accused person”.
Accordingly, court acquitted the accused.
