JAMMU, Dec 15: Crime Branch Jammu has produced challan against Advocate and others for forging registration of a ‘Marriage Agreement’.
The challan in case FIR number 01/2012 under section 420, 193, 465, 466, 468, 471, 120-B/RPC Police Station Crime Branch, Jammu, was produced against Showkit Hussain Khan of Mohalla Khawaja Gilgit Sopore Kashmir, a practicing Advocate in Saddar Court Kashmir, and Haq Nawaz Hussain of Zerwa Bunjwa District Kishtwar, in the court of CJM, Srinagar.
The case was registered on the orders passed by the State High Court at Jammu in a petition titled Haq Nawaz versus State of J&K and others, wherein directions were given to SSP Crime Branch, Jammu to register a case against the petitioner and others who were found involved in preparation of forged registration endorsement on the ‘Marriage Agreement’.
The petitioner Haq Nawaz had approached the High Court seeking directions for the production of Ambika Thakur alias Asia in the court for handing her over to him urging that he had contracted marriage with the latter and she was in illegal detention of one Sunil Kumar of Hatta Kishtwar.
The Marriage Deed, which was produced by the petitioner in support of his claim, was found forged because the Judicial Officer by the name of K.S Sethi indicated to have registered the said marriage document, was reported as non-existent in the Jammu and Kashmir Judicial Services.
During the course of investigation, the said Marriage Agreement and other relevant documents were seized. It was revealed that the documents were executed before K S Sethi, Munsiff Sub-Registrar, Srinagar on 26.11.2011. On verification it came to surface that Marriage Agreement was neither attested/registered in the court of Munsiff, Magam nor in the court of Sub-Registrar, Srinagar. During further investigation, it was established that one Showkat Hussain Advocate had purchased the Stamp papers from Stamp Vendors Sheikh Parvaiz Ahmed and Bilal Ahmed Wani.
The ‘Deed of Declaration’ executed by Ambika Thakur had been prepared and presented by Advocate Showkat Hussain Khan for attestation before Notary Mohd. Aslam Wani. It came to surface that names and signatures of two Advocates namely Showkat Hussain Khan and Farooq Ahmed Wani were found on the documents. FSL Jammu confirmed the authorship of Advocate Showkit Hussain Khan on fake and forged marriage agreement.
