Charges framed against 2 ex-DCs, others in fake gun license scam

JAMMU, Dec 20: Special Judge CBI Jammu Bala Joyti today framed charges against Faqir Chand Bhagat, the then DC Rajouri, Javed Ahmed Khan, the then DC Shopian and Parmod Kumar in fake gun license scam.
As per the prosecution case, on the basis of complaint filed by K K Sharma, the then Additional DG BSF and on the basis of result of enquiry FIR was registered against the accused persons.
In the FIR, it was mentioned that Pramod Kumar Sharma of M/s Nav Durga Gun House, Manhas Market Paloura Jammu, Sukhwinder Singh, Commandant, Faquir Chand, the then District Magistrate Rajouri and some unknown persons as part of criminal conspiracy during the year 2013 got arms licenses issued in lieu of Rs 12,000 each and on the basis of false and forged documents.
As per the prosecution, the then District Magistrate Rajouri (now retired) by misusing his official position, issued all the questioned arms license in violation of existing rules and procedures and without due verification. Constable Parmod Kumar Sharma was in BSF before coming into business of preparation of fake gun licenses whereas Faquir Chand Bhagat remained posted as District Magistrate (Deputy Commissioner) Rajouri from April 2013 to November 2013.
Mohd Aslam Bhatti was performing the duty of Judicial Clerk during his tenure at Rajouri whereas accused Mohd Javed Khan remained posted as District Magistrate (Deputy Commissioner) Shopian and during this period all these accused persons namely Parmod Kumar Sharma, Faquir Chand Bhagat and Mohd Javed connived with each other and issued 12 gun licenses and obtained pecuniary advantage of Rs 1,44,000.
After hearing Public Prosecutor V K Dogra for the CBI, the court observed, “from the entire material on record, it appears that prima facie offences under Section 120-B read with Sections 420, 467,468 and 471 RPC, J&K Prevention of Corruption Act and Section 30 Arms Act 1959 are made out against all accused persons and further certainly there are grounds for proceeding against each of them as such charges are framed against all the accused persons separately”.
