Charges framed in township scam

JAMMU, Mar 3: Special Judge Anti corruption Jammu, Sanjay Dhar today framed corruption charges against Dr Amjad Abass Ansari (brother of Molvi Iftikhar Hussain Ansari), Madan Lal Kalra and B Murlidhar in the much publicized multicrore New Jammu township scam.
After hearing both the sides in length, Special Judge Anticorruption observed, “it is true that it took several years for the investigating agency to complete the investigation of the case but it is also a fact that accused approached High Court by way of different petitions challenging the FIR and the investigation”.
“This also contributed towards the delay in filing of the chargesheet. The accused, therefore, cannot be discharged on the ground of delay in filing of challan. Even in Sajjan Kumar’s case, Supreme Court did not discharge the accused, though the chargesheet in that case was filed after 23 years”, the court said.
“So far as contention regarding validity of sanction for prosecution is concerned, the same does not deserve to be considered because with the death of Molvi Iftikhar Hussain Ansari, the proceedings against him stand terminated”, the court further said.
“There is prima facie case to frame a charge for offences under Sections 420, 467,468,471,120-B RPC read with 5 (2) PC Act against the accused”, Special Judge Anticorruption said, adding Jayant Bhuta and Molvi Iftikhar Hussain Ansari have died during the trial of the case. The case shall now come up for framing of formal charges against accused Dr Amjad Abass, Madan Lal Kalra and B Murlidhar.
