JAMMU, Jan 23: A delegation of Jammu Kashmir Reserve Categories Employees Association (JKRCEA), called on Chief Secretary B R Sharma to apprise him of the Supreme Court’s status quo Interim order in SLP, filed by private respondents against High Court’s verdict of striking down Section 6 of Reservation Act and Rules 9, 10 & 34 of Reservation Rules.
The delegation, led by Dr Sanjay Kumar Bhasin (president), comprised of MLAs Nawag Rigzin Zora, Asgar Ali Karbalie, Sayeed Bakar Hussain (Vice-Chairman, Village Khadi & Kisan Board), and others.
Mr Zora, while interacting with the Chief Secretary, brought into his notice of prejudice/preconceived bias against Reserved Categories by few bureaucrats and even politicians also. He stressed that in view of this there may be some misinterpretations of status quo by few bureaucrats. He requested the Chief Secretary to adequately advise Administrative Secretaries not to misinterpret the Supreme Court judgement that can have severe socio-political and legal implications once the elected Government comes in place.
Asgar Ali Karbalie (MLA), requested the Chief Secretary to direct all Administrative Secretaries to either do not carry out OPG/DPC Promotions or if at all they contemplate such promotions Reserved categories should not be ignored, as they are going to find out political solution to the problem very soon when Government starts functioning under new Chief Minister.
Sayeed Bakar Hussain brought into the Chief Secretary’s notice that political dispensation once in place after Republic day, shall definitely be taking some concrete decision in the matter as the matter has wide socio-political dimensions and obligations in view of large population of reserved categories and their socio-educational & economic status.
Dr Sanjay Bhasin, president of JKRCEA, brought to the Chief Secretary’s notice that some departments, like Education, Agriculture, Horticulture, Finance and Engineering department were either finalizing DPCs or in the process of doing OPG/DPC promotions in gross violation of Supreme Court’s status quo interim order, that may have severe legal repercussions.
The Chief Secretary gave a patient hearing to the delegation and assured them that he would discuss the matter with the concerned and take adequate measure that shall be in the best interest of the reserved categories.
Dr Zabeer Ahmed, Satpal Bavoria, Fareed Choudhary, Gagan Jyoti, Joginder Paul, B R Bhagat, Rameshwar Kumar, Bashir Ahmed Choudhary, Bashir Ahmed Dar, Brij Rana, R C Bhasin were Ved Parkash were also part of the JKRCEA delegation.
