Srinagar, July 30: The Central Information Commission (CIC) has directed the Assistant Commissioner Revenue (ACR), Srinagar to make all the information regarding the Land Acquisition for the Srinagar Ring Road available on its website.
The directives have come after Raja Muzafar Bhat, an RTI activist was denied information on the Land Acquisition process of the project.
The CIC in its judgement has stated that the Commission at the outset observes that the instant matters are complaints filed under the RTI Act, 2005 where the Commission is only required to examine if there is any malafide intent or denial of information due to any unreasonable cause on the part of the PIO.
“…The Commission advises Shri Raies Ahmed Bhat, PIO and Assistant Commissioner Revenue, Srinagar to ensure that the information sought in the RTI application is suo mote uploaded on the website of the Public Authority u/s 4 of the RTI Act, 2005 so as to obviate the necessity of filing an RTI application for seeking the same,” the judgement reads.
Through RTI that was filed, the applicant had sought information such as certified copies of all the notices (village/ patwari halqa wise) issued from Time to Time by the office of Collector / Administrative Department / NHAI 2.
The applicant had also sought details of newspapers that carried the notifications of the aforementioned villages. Date, Name of Newspaper and Newspaper cutting (village wise), copies of objections if any received by the Collectors office Srinagar district from all the villages, details on how did the Revenue Department officials / Collectors office intimated affected people about the proposed land acquisition along with other details.
Having not received any response from the PIO, Complainant approached the State Information Commission, J&K with the instant Complaint and the same was heard by the SIC, then the matter was adjourned on request of ACR, Srinagar because of the scheduled training, finally to the judgement passed by the CIC directing the ACR, Srinagar to make details public and the matter was disposed of.
