CJM directs Crime Branch to fast track execution of warrant

JAMMU, Aug 26: In a case titled “State through Police Station Crime Branch Jammu Vs. Abrar Hussain S/O Mohd. Hussain R/O Gali no. 2 near Wine Shop, Opposite Masjid, New Plot, Jammu”, wherein accused allegedly forged and fabricated NOC Certificate, Salary Certificate and “To whom it may concern” Certificate and sent the fabricated documents to Australian High Commission for obtaining Visa, the court of Chief Judicial Magistrate, Jammu directed Crime Branch to fast track the steps that it has undertaken with a view to procure the production of accused in the court to make him face trial.
It is pertinent to mention here that challan against accused was produced in the court of Chief Judicial Magistrate, Jammu in absentia and general warrant of arrest under Section 512 of Cr.P.C was issued against him as such.
The representative of Crime Branch (Economic Offences Wing), Jammu told the court that look-out circular stands issued against accused by Bureau of Immigration (Ministry of Home Affairs), Govt. Of India on 18.08.2022 and that Sr. Superintendent of Police EOW – Crime Branch, Jammu has also addressed a communication to Assistant Director (IPCC) Central Bureau of Investigation, New Delhi for taking all possible measures permissible under law for procurement of accused from abroad so that his production before the court can be ensured.
Emphasizing on the need to execute general warrant of arrest against accused, the court noted that “no equivocation needs to be harboured that general warrant of arrest issued against an accused has to be executed with complete earnestness”, adding, “in the event of warrant remaining unexecuted, very core of requirement of law to bring an accused to justice, indeed is corroded both in law as also in public perception.”
Pertinently, FIR in the case was registered on the asking of the then Registrar Vigilance, High Court of J&K.
