JAMMU, Oct 25: In a complaint filed by one Surjeet Singh seeking direction for registration of FIR against Dr Shashi Gupta, Principal Government Medical College Jammu for allegedly committing offences under Section 465, 467 and 468 RPC, Chief Judicial Magistrate Jammu, S R Gandhi today directed SSP Crime Branch to conduct preliminary enquiry in to matter and register FIR if offences are established.
In the complaint, it has been alleged that Dr Shashi Gupta immediately after joining as Lecturer in the Department of Gynecology, Government Medical College, Jammu applied for four days leave from February 7, 1989 and thereafter remained unauthorizedly absent for 4 years, 10 months and 20 days up to December 27, 1993.
During this period, she had gone out of country unauthorizedly. After her return from abroad, she was allowed to join back and thereafter was given promotion to the higher post without settling her unauthorized absence period. Her period of absence was treated as Dias-Non vide Government Order No.598-HME of 1997 dated July 3, 1997 as such the period could not have been counted for any type of service benefits including promotion.
It has further been alleged in the complaint that when the case of Dr Shashi Gupta was considered for promotion against the post of Assistant Professor, the J&K PSC had cleared the promotion on notional basis from April 23, 1995 and regular from June 25, 1996 whereas as per Government Order No.494-HME of 1996 dated 26.7.1996 the promotion had been given to Dr Shashi Gupta with effect from April 23, 1994 which was not legally possible as the recommendation for promotion to the gazetted service had to be made by the J&K PSC.
“The Government order looks to be a forged one and by manipulation the benefit of promotion was given to the Dr Shashi Gupta from the date it was not recommended by the J&K PSC thereby making her as Assistant Professor with effect from April 23, 1994 which inter alia ensured the payment of higher salary to Dr Shashi Gupta from the Government exchequer and also giving her illegal benefit of seniority and promotion by which the Government exchequer has been put to grave loss”, the complaint said.
“Even the record whereby the illegal benefits have been given to Dr Shashi Gupta has been deliberately misplaced in order to hide the crime committed by the Dr Shashi Gupta and other officers/officials”, the complaint said, adding “proper investigation is required to be conducted so that Dr Shashi Gupta as also other persons involved in the whole crime are taken to task”.
