CJM refuses to direct SHO for registration of FIR in fake, fabricated case

JAMMU, Aug 5: Chief Judicial Magistrate (CJM) Jammu Amarjeet Singh Langeh has refused to direct Station House Officer (SHO) Police Station City for registration of FIR in fake and fabricated case.
As per police sources, Chief Judicial Magistrate Jammu Amarjeet Singh Langeh dismissed application of a man namely Mohammad Asif Jan seeking registration of FIR under Section 156 (3) of CrPC against Haji Mohammad Ashraf, son of Ghulam Mohammad Matoo, Zamroda Bano, wife of Haji Mohammad Ashraf and Abid, son of Haji Mohammad Ashraf, all residents of Christian colony, Jammu because of allegations that accused snapped water supply of tenants of applicant/complainant and that accused have malafide intention to cause grievous hurt to applicant besides alleging that accused always keep on threatening the complainant.
The complainant also alleged in the complaint that he also approached SHO Police Station City Inspector Deepak Katoch with complaint but his grievance remained unaddressed, sources informed.
“Before proceeding further in the matter, the court of Chief Judicial Magistrate, Jammu called status report from Police Station City Jammu, according to which applicant and accused are related to each other and that they have a dispute over residential house which one of the accused has purchased”, sources stated.
However, while dismissing the application, the Court observed, “there indeed is a looming dispute over residential house which Haji Mohammad Ashraf has purchased alongwith one Ghulam Hassan.”
“In nut shell, neither application in hand nor the status report allude commission of any cognizable offence(s) to persons against whom section 156(3) of CrPC is sought to be invoked in the application in hand and indeed controversy interse parties seems to be purely a civil dispute.” added the court.
With these observations, the court dismissed the application of the applicant seeking the registration of FIR.
