CJM warns petitioner from filing repeated applications

JAMMU, May 19: Chief Judicial Magistrate (CJM) has warned the petitioner from filing repeated applications.
In an application titled “Mumtaz Ahmed Phamda versus UT of J&K through Police Station Nagrota Jammu” seeking release of bovine animals, Court of Chief Judicial Magistrate, Jammu warned the petitioner to remain cautious in future and desist from the practice of filing repeated applications for same subject matter when the applications moved earlier was still pending for disposal.
This order came to be passed by the court on the application of petitioner which was 5th in the series while as four similar applications moved earlier were transferred to different courts. Two of them were found to have been transferred to the court of Sub-Registrar, Jammu, another to the Court of Excise Magistrate, Jammu and 4th one to the Court of Municipal Magistrate, Jammu for disposal under law.
“Filing repeated applications with regard to same subject matter time and again without waiting for disposal of the applications moved earlier is a tendency that needs to be deprecated, for, it has repercussions”, remarked the court and when petitioner was confronted with this aspect, he straightway apologized and submitted that in future he would remain cautious and would never resort to repeated filing of applications like one on hand.
After warning petitioner to remain cautious in future from the practice that he resorted to as aforesaid, the court dismissed the application.
