JAMMU, Aug 16: Division Bench of High Court comprising Justice Virender Singh and Justice Tashi Rabstan today directed the State Government to consider the continuation of the present Chairperson and Member of the State Accountability Commission until the regular appointments.
The direction was passed in a Public Interest Litigation (PIL) titled Sheikh Mohd Shafi and Another Versus Union of India and Others.
After hearing battery of lawyers, the DB observed, “Senior Advocate Sunil Sethi appearing for the Accountability Commission submits that this vital organization has virtually been made defunct by the State by not making it operational in its true sense as also observed by this court in one of its orders while dealing with providing of staff and investigation wing to the Commission”.
“The counsel has submitted that the State Government is intentionally dilly dallying the matter of appointing Chairman and Member of the Commission as no effective steps have been taken by the State from July 8 till first week of August even for fixing any date of the meeting of the select committee”, the DB said, adding “this speaks volume of the intention of the State”.
“We are of the opinion that in the interest of the Commission, Government may consider continuation of the present incumbents until regular appointments are made”, the DB said.
