Srinagar, Mar 26: High Court today remanded the case of senior National Conference leader and former Deputy Speaker of Assembly Nazir Ahmad Khan Gurezi to State Accountability Commission (SAC) with the direction not to proceed ahead in the complaint against Gurezi without considering his objections to the complaint.
The Division Bench of Justice D S Thakur and Justice Tashi Rabstan while disposing off the petition of Gurezi wherein State Accountability Commission was directed not to proceed ahead in a complaint filed against Nazir Ahmad Khan (Gurezi), remanded the case back to Commission with the condition not to proceed ahead in the complaint against the Gurezi till objections are considered.
The complaint has been filed before the Commission stating that Gurezi and his two brothers have received an excess amount of Rs 1,37,77,000 for Shamilat land coming under Kishen Ganga Hydel Project.
The Commission while taking cognizance of the matter issued notice to the Gurezi and before the proceedings could have been processed further in the complaint, Gurezi approached the High Court with a plea that the complaint against him was defective and the Commission without rectifying the defects took cognizance of the matter which under the provision of SAC Act was not permissible.
High Court had stayed proceedings in the complaint pending before the Commission in the year 2017 and the Division Bench today disposed off the petition of Gurezi with the direction to the Commission to consider the objections of petitioner and till then not to proceed further in the matter.
