SRINAGAR, Sept 9: The High Court today initiated contempt proceedings against Director Colleges, Kashmir and Principals of various Degree Colleges for wilful disobedience of court orders and asked the Registry to frame rule against the erring official.
“Prima facie the Court is satisfied that the respondents have committed contempt of the Court, therefore, Registry is directed to frame rule against the respondents”, Justice Ali Mohammad Magrey directed.
Court has sought report from Director Colleges and Principals of Degree College Kulgam, Bandipora and Magam explaining therein as to why they shall not be punished for contempt of the Court and shall report compliance allowing the petitioners in tune with the directions passed by this Court.
Senior Counsel Jehangir Ganai on behalf of ousting teachers alleged violation of orders in terms whereof the Court while issuing notice to other side had in the meanwhile, directed the respondents that the petitioners-teachers shall not be replaced by a similar adhoc/temporarily/contractual arrangements, with further direction to allow the them to continue discharging their duties at the present arrangement and shall be paid legitimately earned wages in accordance with the rules.
On notice in the contempt proceedings, respondent-Director Colleges, Higher Education Department, has filed the statement of facts, admitting the discontinuation of the petitioners on the ground that their tenure of academic arrangement on completion was substituted by the candidates, who had competed the process of selection for subsequent year.
Director Colleges Kashmir in its report submitted that as per the practice in vogue the applications were invited by the Nodal Principal for engaging the academic arrangement candidates for the academic session 2021-2022 as per the need in particular subjects, merit list was prepared and after counseling the successful candidates were deputed to different colleges for imparting Education.
