Cop booked under NDPSA acquitted

JAMMU, Aug 3: Principal Sessions Judge Jammu Vinod Chatterji Koul has acquitted Senior Grade Constable Birbal, son of Hem Raj, resident of Sulgar Jaganu, Udhampur, who was arrested by the Gandhi Nagar Police under Narcotic Drugs and Psychotropic Substances Act (NDPSA).
After hearing Advocate Vishal Kapur appearing for accused person, the court observed, “there is evidence on record that recovery of the contraband was made at a place where there were number of civilians and they could have been easily associated with the investigation but the IO has not done so”.
“No effort has been made to associate any independent witness with the investigation of the case and keep the ring on Supurdnama of independent witness. Had the IO made effort to associate independent witnesses with the investigation or an effort to keep the ring used for sealing on Supurdnama of independent witness that would have at least assured that there was no chance of the ring being again used for sealing any material”, the court said, adding “even the ring has not been produced in the court”.
With these observations, court dismissed the challan and acquitted the accused.
