Court accepts ACB closure report in alleged corruption case

JAMMU, July 23: Special Judge Anticorruption Rajouri Mehmood Sheikh has accepted the closure report filed by Anti-Corruption Bureau in alleged corruption case against Mohd Murtaza Khan, the then Patwari Halqa Timbra.
After going through the closure report, the Special Judge Anticorruption observed, “IO in his report reported that on the basis of oral evidence as well as documentary evidence collected during the course of investigation, the allegations of bribe leveled by the complainant against the Patwari Murtaza Khan could not be substantiated as witnesses except the complainant and his brother have refuted the allegations of bribe in their statements”.
“Only the statement of complainant and his brother have corroborated the allegations but the other relevant witnesses Mohd Bashir, Mohd Nazeer, Qaramat Hussain, Mohd Ajaz refuted the allegations of bribe leveled against the Patwari. The Nishndehi report of the commission also proved that the report of the Patwari is based on facts”, the court said, adding “the complainant actually wanted Patwari to give report in his favour so that the charges of offence under Section 447 RPC to be established in criminal case registered on his complaint against Mohd Khalil and others but the Patwari did not report as per his wishes rather submitted report on facts”.
“So on the basis of vengeance complainant lodged the complaint against the Patwari. The commission of offence under Section 5(1) (d) read with 5 (2) J&K PC Act and Section 4-A of J&K PC (Amendment) Act 2014 have not been proved against the public servant and court is of the considered opinion that the investigation conducted by the IO has fairly come to the conclusion that no case of alleged corruption has been made against the public servant”, the Special Judge said while accepting the closure report.
