Court acquits 2 accused in murder case

JAMMU, Nov 23: Principal Sessions Judge Kathua, M K Hanjura has acquitted Rakesh Kumar and Mohinder Singh, who were facing trial in murder case, as no reliable evidence could be produced in support of prosecution story. However, the Court issued General Arrest Warrant against Sudershan Singh.
According to the police case, on August 2, 2010 a dead body was found lying in Kori Nala. It was identified to be that of Jeewan Lal, son of Ramalu Ram of Poulka. The cause of death could not be ascertained immediately and proceedings under Section 174 CrPC were initiated to find out the reason that led to death.
During the proceedings, the commission of crime was traced to the accused. Accordingly, a case under Section 302/34 RPC was registered. The investigation revealed that during the intervening night of July 31 and August 1, 2010, the accused namely Rakesh Kumar, Mohinder Singh and Sudershan Singh in furtherance of a common intention killed Jeewan Lal.
After hearing PP Ravi Gupta for the State whereas Advocate Bharat Bhushan Sharma for the accused persons, Principal Sessions Judge observed, “there is no reliable evidence on record that could be considered by this Court for holding the accused guilty of offence”, adding “a judicial process cannot be issued in the matter as the circumstances of the case do not, in any way, connect the accused with the crime”.
With these observations, Court acquitted the accused namely Rakesh Kumar and Mohinder Singh and issued General Arrest Warrant against Sudershan Singh.
