Court acquits 2 in NDPS case

JAMMU, July 27: Principal Sessions Judge Kathua, MK Hanjura has acquitted Ravinder Singh, son of Sagar Singh of Mishriwala and Subash Singh, son of Baj Singh of Purkhu, who were facing trial in NDPS case for the last 10 years.
After hearing both the sides, Principal Sessions Judge Kathua observed, “this case has been dragged for ten years since the alleged date of occurrence during which  any accused,  if he is a normal human being, will undergo terrible mental agony,  torture,  pain and suffer anguish and anxiety about an uncertain,  vague,  unstructured future both of his life and job”.
“This fate may result in the accused suffering depression.  In this long journey of ten years, the right to speedy trial has become causality at every level”, the court said, adding “prosecution has not presented its case in a manner beyond any shadow of doubt”.
“The samples have been sent for chemical analysis after a long delay.  Where did the samples remain for such a long time remains a mystery that has not been unravelled.  The prosecution has failed to connect the accused with the crime”, the court said.
With these observations, Court acquitted both the accused.
