Court acquits 5 accused involved in rape case

JAMMU, June 8: Principal Sessions Judge Poonch Kishore Kumar acquitted Mushtaq Ahmed, Shakeel Ahmed, Mohd Bashir, Sajjad Ahmed and Israr Ahmed, all residents of tehsil Mandi district Poonch, who were facing trial for the last five years in an alleged kidnapping and rape case.
According to the police case, on July 18, 2007 all the accused persons kidnapped the prosecutrix and took her forcibly first to Poonch and then to Jammu where Mushtaq Ahmed  committed rape  upon the prosecutrix.
On the receipt of complaint in this regard Mandi Police registered a case and started investigation. Later, the prosecutrix was recovered from the possession of accused Mushtaq Ahmed and handed over to her father. After completion of the investigation the charge sheet was filed against the accused persons.
After hearing both the sides, Principal Sessions Judge observed, “from the evidence it came to fore that the prosecutrix was not kidnapped and raped by the accused as alleged by the prosecution”, adding “as the prosecution has miserably failed to bring home the guilt the accused is acquitted”.
