Court acquits 6 accused in murder case by giving benefit of doubt

JAMMU, Dec 6: Principal Sessions Judge Samba, Kartar Singh has acquitted six accused in the murder case by giving them benefit of doubt.
The accused, who have been acquitted of the charges, are Subash Singh, son of Krishan Singh, Rajesh Singh, son of Jagdish Singh, Vijay Singh, son of Krishan Singh, Ranjit Singh, son of Jagdev Singh, Rakesh Singh, son of Jagdish Singh and Ikram Singh, son of Netar Singh.
As per the police challan, the victim Surinder Singh and the accused persons were having enmity due to irrigation of the land and the parties had quarreled with each other on a number of occasions. The accused persons were also on inimical terms with Surinder Singh over installation of a gate in the lane. Due to this enmity, on June 28, 2007, the accused persons brutally assaulted Surinder Singh, who later succumbed to injuries in the hospital.
After hearing Special Public Prosecutor S S Sambyal appearing for the State whereas Advocate Rajesh Kotwal with Advocate Arvind Gupta for the accused persons, Principal Sessions Judge observed, “the prosecution witnessed have narrated different story during the investigation while in the court a new story has been introduced by them. There were no eye witnesses of the alleged occurrence as per the FIR registered at the instance of the wife of the deceased but from where the five eye witnesses nawely Shrista Devi, Santosh Kumari, Shakti Devi, Raksha Devi and Kamlesh Devi have been introduced at the later stage of the investigation, has not been explained either by the witnesses or by the investigating officer”.
“The fair investigation is the constitutional right of the accused but prosecution has put forth two parallel stories regarding the alleged occurrence and as such it has become difficult for the court to separate the grain from the chaff”, Principal Sessions Judge said, adding “the law is settled that in such a situation benefit of doubt always goes to the accused. They are, therefore, given the benefit of doubt and acquitted of the charges framed against them”.
