Court acquits accused as witnesses turn hostile

JAMMU, July 30: Additional Sessions Judge Jammu, R N Wattal today acquitted Vijay Pal, Suresh Kumar, sons of Parasram of Kattal Batal, Zahir Abbas and Zulfkar Ahmad of Kotli Kalaban, Rajouri, who were facing trial in the murder of saint.
According to the prosecution case, on February 9, 2008 a corpus was recovered from the bank of Tawi under the jurisdiction of Nagrota Police Station and later it was identified as that of saint namely Jagdish Raj, son of Ram Saran of village Kattal Batal.
During the course of investigation, all the four accused were arrested and after completion of investigation challan was presented in the Court of law.
After hearing Additional Public Prosecutor Vijay Kumar Sharma for the State whereas Advocate R K Kotwal for the accused persons, Additional Sessions Judge observed, “the witnesses have not supported the prosecution story. The witnesses, who as per the prosecution story had seen the accused near the cottage of the deceased, have turned hostile”.
“The witnesses have denied even their statements recorded by police under Section 161 of the CrPC”, the Court further said and acquitted the accused with the observations that the prosecution has miserably failed to prove the guilt against the accused beyond any reasonable doubt.
