Court acquits accused facing trial under NDPS Act

JAMMU, May 17: Principal Sessions Judge Kathua, M K Hanjura today acquitted one Amarjeet Singh, son of Babu Ram of Basohli, who was facing trial for the last seven years in NDPS case.
According to the police case, on April 10, 2006 the accused was arrested and from his possession 387 intoxicant capsules and 10 bottles of intoxicant syrup were recovered.
While acquitting the accused, Principal Sessions Judge Kathua took serious note of the police witnesses and observed, “a mild digression here in this case will not be out of place. It needs to be mentioned here that the most important police witnesses in the case, be they the informant, the investigator, the one who dispatched the samples for chemical analysis or the carrier of the samples to the FSL, have not been examined in the instant case involving a serious offence”.
“This appears to be common phenomena now. It renders the trials in the courts less than fair with no real spine in them. Take the instant case. About forty opportunities during the period commencing from September 16, 2008 to January 17, 2013 have been given to the prosecution to examine 13 witnesses listed in the calender of witnesses. All except four police witnesses have appeared for examination”, the Court said.
“On the failure of these cases the buck is passed on to others. Is it not the time to think and ponder that the police witnesses should not only be held accountable but should also stay in touch with the prosecution in cases where they are the witnesses or the investigators? Is it not in the public interest?”, the Court asked.
