Court acquits accused in abetment to suicide case

Excelsior Correspondent JAMMU, Dec 10: Principal Sessions Judge Samba Kartar Singh has acquitted one Jagbir Singh, who was facing trial in abetment to suicide case for the last 10 years, as prosecution miserably failed to prove its case. According to the police case, on August 8, 2002 the complainant Swaran Singh lodged a written report in the Police Station Ramgarh stating therein that his daughter Kamlesh Kumari, who was married to Ranjit Singh, son of Nath Ram died because of torture meted out to her by her husband and brother-in-law Jagbir Singh. On the receipt of complainant, a case for the commission of offence Section 306 RPC was registered against the accused Ranjit Singh and Jagbir Singh and after completion of investigation challan was presented in the court of law. After hearing counsels for the State as well as accused persons, Principal Sessions Judge observed, “there is no doubt about the fact that Kamlesh Kumari has died because of poisoning which was consumed by her. She was undoubtedly hyper sensitive to ordinary pins and pricks of the family because sensitivity of each individual differs from person to person. Each individual has his own idea of self-esteem and self-respect. Different people behave differently in a same situation. It is unfortunate that such an episode of suicide had taken place in the family but it cannot be said that the accused is in any way connected with that unfortunate act”. “Prosecution has miserably failed to prove its case against the accused beyond reasonable shadow of doubt. The main accused has already died in this case and the accused Jagbir Singh has not been connected with the alleged offence in any manner. He is, therefore, acquitted of the charge framed against him”, the Court said.
