Court acquits Patwari, directs IG Crime to take action against IO

JAMMU, Dec 9: In an embarrassing situation for the Crime Branch, Special Judge Anticorruption Sanjay Dhar today acquitted Patwari, Suraj Parkash, who was allegedly involved in changing revenue record and directed the Inspector General of Crime Branch to proceed against the Investigating Officer after seeking explanation from him.
After going through the case and hearing Advocates Ashok Mishra and M M Gupta for the accused persons, Special Judge Anticorruption observed, “it is a case where exclusive possession of complainants has been struck off and in its place possession of accused Balbir Singh has been reflected”.
“Investigating agency has not referred these insertions for opinion of handwriting expert nor has it recorded the statements of the persons, who are acquainted with the handwritings of Patwaris, who were posted in the concerned Patwar during the relevant period”, the court said, adding “this is a lacuna which has proved fatal to the prosecution case thus the responsibility lies solely with the investigating officer for which he owes an explanation”.
With these observations, the court said, “the prosecution has failed to establish the charges against the accused”. While dismissing the charge-sheet and acquitting the accused, court directed that the copy of judgment shall be forwarded to IG Crime with a direction to proceed against the Investigating Officer after seeking an explanation from him in the light of observations.
