Court acquits wife in husband’s suicide case

JAMMU, Apr 20: Principal Sessions Judge Kathua, M K Hanjura has acquitted Anu Devi, wife of Preeti Ram and her brother Mukesh Kumar of the charges of abetment to suicide of Preeti Ram, who was found hanged at his residence on February 20, 2005.
According to the police case, Anu Devi and Preeti Ram were having estranged relations as they were not blessed with any child even four-five years after their marriage and they used to quarrel with each other over the issue very often. On February 20, 2005, Anu Devi and her brother Mukesh thrashed the deceased. These acts of omission and commission on the part of the accused instigated and abetted the act of the deceased to commit suicide.
On the statement of Sheela Devi, mother of the deceased a case was registered at Police Station Basohli against the accused and on the completion of the investigation charge-sheet was presented in the Court of law.
After hearing Public Prosecutor Ravi Kumar Gupta for the State whereas Advocate T N Gupta for the accused persons, Principal Sessions Judge observed, “the prosecution has failed to connect the accused with the commission of the crime. The nexus, logical or factual, between the death of the deceased and the alleged acts of the accused has not been established. The deceased had no reason to put an end to his life”, adding “prosecution case suffers from contradictions and inconsistencies which cut at the very root of the case”.
“The witnesses have narrated the occurrence of the event after a great wait. This has damaged the credibility of the prosecution case. A judicial process which can only be issued on the firm foundations of credible evidence cannot be issued in the instant case”, the Court observed and acquitted the accused of the charges leveled against them.
