Court awards 11 yrs RI in rape case

JAMMU, Mar 18: Additional Sessions Judge Udhampur, M K Sharma today awarded 11 years rigorous imprisonment to Kumar Singh, son of Badri Nath of Kalsot, Udhampur, who was facing trial for the last more than six years for raping a minor.
According to the police case, on July 11, 2006 prosecutrix had gone to attend the call of nature in the forests at village Kalsote when she was kidnapped by the accused persons, who took her to different places and she was ultimately recovered from the possession of the accused Kumar Singh.
After hearing Additional Public Prosecutor Tariq Mujahid Mughal for the State whereas Advocate Jarnail Singh for the accused persons, Additional Sessions Judge observed, “this is a case in which a minor girl has been kidnapped.  The manner in which she was kidnapped, dragged and ravished shows its seriousness. Therefore, in the present circumstances the accused cannot be released on probation of good conduct under Section 562 CrPC nor he can be benefited under Probation of Offenders Act”.
“The charge sheet was presented in the court on August 10, 2006 and the convicts faced the trial for more than six years. In view of the facts and circumstances of the case, the accused Kumar Singh is sentenced to rigorous imprisonment for 8 years for commission of offence under Section 376 RPC, rigorous imprisonment for three years for the commission of offence under Section 363 RPC, rigorous imprisonment for one month for the commission of offence under Section 343 RPC”, the Court said, adding all the sentences will run concurrently.
