Court awards 5 yrs RI to narcotics smuggler

JAMMU, Dec 5: Principal Sessions Judge Ramban, Mohd Akram Choudhary has awarded five years imprisonment and fine of Rs 50,000 to Bhupinder Singh, son of Harbans Singh of Biaspur, tehsil R S Pura in NDPSA case.
According to the police case, on October 6, 2007 information was received at Police Station Banihal from reliable sources that a person namely Bhupinder Singh, who deals in drugs, was traveling from Khannabal to Jammu in Tanker No JK05-A/3599 with some consignment of cannabis and poppy straw.
Accordingly, police team swung into action and intercepted the truck being driven by one Dev Raj Sharma, son of Harihar Sharma of Kothi Ghari, Udhampur. From the possession of Bhupinder Singh, police recovered more than one and half kilograms of cannabis.
After hearing Public Prosecutor G N Manhas appearing for the State whereas Advocate T H Malik for the accused person, Principal Sessions Judge observed, “the object of awarding sentence is to protect the society and to deter the criminals. The sentence has to be stern. By imposing meager sentence in view of liberal attitude or taking too sympathetic view will be counter productive in long run and against the interests of the society which needs to be taken care of and strengthened by string of deterrence inbuilt in the sentencing system”.
“The Court has to keep in mind not only the rights of the victims of the crime but the society at large while considering the imposition of appropriate sentence”, Principal Sessions Judge further said and awarded rigorous imprisonment for five years and fine of Rs 50,000 to the accused.
