Court awards 5 yrs RI to rapist

SRINAGAR, Nov 19: A local court today awarded rigorous imprisonment to a convict for raping a minor girl fifteen year ago.
Additional Sessions Judge in the Fast Track Court, Shazia Tabasum, sentenced the accused for five years rigorous imprisonment for rape offence under Section 376 RPC and four years rigorous imprisonment under Section 366RPC, and also imposed a fine of Rs. 10, 000 on him.
The court said the substantive sentence of imprisonment awarded to convict will run concurrently.
The court in its judgment observed that the accused is involved in the crime against the women deserves to be dealt with iron hand and as such element of the society does not deserve any leniency.
The Judge directed the Additional Public Prosecutor to take the convict in the custody and lodge him in Central Jail Srinagar.
In December 1997, parents of the victim (name withheld) had filed a written report at Shergarhi Police Station, saying their 15 -year-old daughter was enticed by Mohammad Yaseen Bhat of New Colony Batmaloo.
After filing an FIR under 439/1997 police had arrested the accused along with the girl in Jammu along with a taxi bearing No. 1356/KMT.
During the course of investigation and report of doctors, it was established that rape had been committed and accused was booked under Section 376 RPC.
On September 25, 1999 the charges were framed against the accused, but he pleaded not guilty. The prosecution during the course of action examined five witnesses and later proved the charges against him.
