Court convicts drug peddler

SRINAGAR, Feb 12: The Additional Sessions Judge Srinagar today convicted an accused involved in drug trafficking and sent him to Central Jail Srinagar.
The accused Mohammad Junaid Raina of Kaloosa Bandipora was today convicted by the court of 4th Additional Sessions Jusge Gowhar Majid Dalal for commission of offences under NDPS Act.
Court said the accused involved in FIR 113/2020 registered with Police Station Parimpora in Srinagar is found in possession of commercial quantity illegal drug (contraband), for which he has not given any legal justification.
Court said the prosecution has succeeded in proving the case against accused-Raina beyond any shadow of doubt and accordingly convicted him for the commission of offence under section 8/21 NDPS Act.
Since the accused was released on bail and was present in court today and the court directed for sending him to custody in central jail Srinagar, to serve the sentence.
“Superintendent central jail Srinagar is directed to produce the convict in person on next date positively to hear him on quantum of punishment/sentence”, Court directed.
It may be mentioned here that on 23.06.2020 the police party headed by SHO Parimpora was on naka duty near Ansari Crossing adjacent to Toyota Show room and in the meantime one vehicle City Honda bearing no. UP16Ay-5846 was carrying illegal drug and one strip of same contraband was also recovered from personal search of accused and to this effect seizure was prepared.
Court while convicting the accused recorded that the prosecution has successfully established its case against accused in light of the evidence brought on record and there is nothing on the file which would suggest that the accused person has not committed the offence mentioned supra.
Court directed that the seized contraband to be destroyed after the appeal period is over. Court also directed for confiscation of the vehicle used for the commission of offence.
“So, vehicle is liable for confiscation under section 60 of NDPS Act and accordingly orders of confiscation are passed regarding offending vehicle in terms of section 63 of NDPS Act after the period of appeal is over”, court said.
