Court convicts husband for wife’s murder

Srinagar, Nov 18: A fast track court has convicted the husband for killing his wife in Budgam district way back in 2011.
The court of Additional Sessions Judge (Fast Track) Budgam presided over by Aijaz Ahmad Khan after appreciating the evidence produced by prosecution and also having regards to the statement of the accused recorded before court concluded that the prosecution has been able to prove the guilt of the accused-Mushtaq Ahmad Pandit of Tangnar Kralpora.
The court accordingly held Pandit as guilty of the offence under Section 302 RPC (murder) and convicted for the offence of murder of his wife-Sameera Jan of Nawa-Kadal Srinagar.
“Let the file come up for arguments on sentence on 23-11-23 and since the accused is already in custody therefore, Superintendent Central Jail Srinagar is directed to produce the convict mentioned above on next date of hearing”, Court further directed.
As per the prosecution story, the accused and deceased were last seen together and accused in their statements have also stated that he and deceased were seen together going to their house in the evening of May 1, 2011 when the deceased had gone to attend the marriage function of one of the cousins of the deceased.
Accused in his statement of accusation has stated that on the fateful day he was at his work place and all the witnesses produced by prosecution have given wrong statement and deceased has committed suicide.
“These facts have not been put forth by the accused by evidence in defence. Prosecution has put forth all the evidence and the accused was required to put forth his defence which the accused has not despite opportunities. All the witnesses were made available to the accused”, court said.
It was on 01-05-2011 an information through some reliable source was received by Police Station Chadoora, to the extent that the deceased was married to the accused and was killed by the accused. The dead body was lying in the house.
Upon this information instant case came to be registered and investigation set into motion during the course of which higher authorities came to be informed and the place of occurrence was identified and closed and FSL team was called.
On spot , the dead body was identified and taken into custody regarding which documents were prepared. Dead body was recovered from the house of the accused from first storey.
Dead body was having a number of cuts and a knife in the back which was taken out during the post mortem at SDH Chadoora and accordingly seized. Statements of eye witnesses came to be recorded.
On the day of occurrence, the family members of the deceased were present in the house of the uncle of the deceased in connection with some marriage function who were not having any knowledge about the occurrence.
