JAMMU, Apr 9: The court today rejected the bail petition of Radhey Shyam Chowdhary, son of Amarnath Chowdhary and his Accountant Kaka Ram besides revoking the interim bail granted in their favour vide order dated 17/03/2016 in the case of dispute of the mall situated at Akhnoor Road .
1st Additional Session Court’s Judge, M A Chowdhary gave this verdict on Radhey Shyam Chowdhary and Kaka Ram V/s State through IGP & SSP Crime Branch, Jammu in case No. 24/2016 V/s 420/406 and 120-B of RPC.
This is the same case wherein Amarnath Chowdhary has been sent to judicial custody. Some land belonging to the owners was to be developed in a commercial mall. It was agreed upon as per the agreement that the sale recovery shall be shared in the ratio 35:65 by Amar Nath Chowdhary, Radhey Sham Choudhary and Mohini Devi (land owners) and M/S Riddhi Siddhi Infraprojects Pvt Ltd (Developer). As per agreement the developer company had to build and sell the Mall. The land owners and the company invited offers from the public at large for the sale of shops/commercial sites and after the company completed its job, the letter of offer of possession for fit outs were issued by the company to respective buyers in January 2015. The developers being non state subjects were not able to buy or sell any property, therefore, this task was required to be executed by the land owners who kept dilly dallying the matter by making fake excuses and assurance and without executing any sale agreement had received their share of money amounting to crores of rupees thereby depriving more than 200 people, swindling and misappropriating their money.
The land owners in furtherance of criminal conspiracy hatched with his Accountant Kaka Ram with malafide intention and in order to usurp the entire property had misled the buyers and the developer company through deceitful means after receiving huge sum of money from them solely in order to cheat and dupe them.
