JAMMU, Apr 4: Chief Judicial Magistrate Kathua Amarjeet Singh Langeh today rejected the bail application of one Suleman, son of Mohd Yousaf of Billawar, who was allegedly involved in kidnapping and rape case.
After hearing both the sides, the CJM observed, “it requires no emphasis that while dealing with application for grant of bail in non-bailable offences court is required to have due regard to the gravity and seriousness of the offence, punishment that alleged offences carry, chance of accused to give a slip to law, likelihood of influence and intimidation on prosecution witnesses, obstruction of investigation and likelihood of repeat of offences by the accused”.
“Court is also expected rather required to examine and consider the impact of alleged offences on the values cherished by society and in the case at hand there is prima-facie evidence regarding involvement of petitioner in kidnapping of prosecutrix”, the CJM said, adding “main accused in the case namely Mohd Yaqoob is still at large”.
With these observations, court rejected the bail application.
