Court denies bail in murder case

SRINAGAR, Oct 9: A local court today denied bail to an accused involved in murder of a woman over the land dispute.
The court of 4th Additional District & Sessions Judge Srinagar presided Haq Nawaz Zargar while refusing to grant bail to two accused involved in a murder case said the allegations leveled against the accused are still intact and has not been altered or deleted.
Court said that the applicants have been charged with very heinous crime of murder of a lady along with the other accused persons in the case. “I find no merit in the instant application also, thus same is rejected. However a direction is given to the Superintendant Central Jail, Srinagar to take proper care of the accused by following SOPs issued by the Government from time to time”, court concluded.
Court at the instant stage said, is not inclined to feel that the applicants are entitled to bail. “What requires to be noticed while declining the bail application is the nature and circumstance of the offence, nature of evidence, circumstances which are peculiar to the accused, reasonable apprehension of the witnesses being tempered with, a reasonable possibility of the presence of the accused at trial and larger interest of the public or the state”, reads the judgment.
Court said, since the statement of all the prosecution witnesses had already been recorded, so this fact does not have any influence in the instant case but other factors do like the gravity of the offence and the innocence of the offence, reasonable possibility of the presence of the accused as the trial is yet to conclude in addition to the larger interest of the public or the state.
