Court denies bail in rape case

JAMMU, Feb 19: Chief Judicial Magistrate Reasi Kamlesh Pandita today rejected the bail applications of Romesh Lal , who was arrested by the police under 376/109 RPC.
After hearing CPO DP Singh for the State, the CJM observed, “the investigation is in progress and the allegations leveled against the accused are very serious and also against the public at large”.
“The law regarding bail is trite that bail is a general rule and its denial is an exception to the general rule. In this case, the allegations are very serious and considered to be menace as well as threat to the development of society at large”, the court said, adding “such offences are not being taken in good taste by the prudent mind of the society, so, the liberty of any individual/accused person is to be balanced with that of the impact of the offence on the society”.
“Sexual violence apart from being a de-humanization act is an unlawful in terms of the right of privacy and sanctity of a female. It is serious blow to her supreme honour and offends her esteem and dignity. The crime of rape is not only a crime against the person or women, but it is regarded as crime against the whole society”, the court further said, adding “personal liberty guaranteed to the accused is undoubtly their valuable right guaranteed under Article 21 of the Constitution, but same can be refused to the accused in accordance with the procedure established under law”.
With these observations, court dismissed the bail application.
