JAMMU, Sept 3: Principal Sessions Judge Jammu, RS Jain today rejected the bail application of alleged narco smuggler namely Aman Chawala, who was arrested by Pacca Danga Police on August 20, 2014 under NDPSA.
After hearing both the sides, Principal Sessions Judge observed, “in the present case, the recovery of charas from accused prima facie shows that he was transporting for sale without any authorization or permission and was indulging in the illicit trade of peddling drugs”.
“In recent past, the number of persons caught with drugs has increased manifold. This increase is apparently partly due to the easy money made in this illegal trade and that bails are invariably granted in cases, which do not involve commercial quantity”, the court said, adding “looking to the trend of bails in such cases, the drug traffickers have become clever enough to ensure that they keep illicit drugs in their possession below the commercial quantity”.
“The enactment of the NDPS Act is aimed at curbing the ever increasing menace of drug peddling and illegal sale and its ramifications on the society and the youth in particular”, the court said, “drug peddling is also a cause for increase in the crime rate”.
With these observations, court rejected the bail application of narco smuggler.
