Court denies bail to cop in charas smuggling case

JAMMU, Dec 25: Principal Sessions Judge Kathua, M K Hanjura has rejected the bail application of Bansi Lal Parihar, the then Incharge Malkhana, who was involved in charas smuggling case.
According to the police case, on October 20, 2012 SHO Police Station Kathua learnt from a reliable source that the accused/petitioner in his capacity as Incharge Malkhana Kathua clandestinely removed contrabands from the Malkhana and sold the same to people. It was also learnt that the petitioner had hidden a large number of charas in his house.
After hearing Advocate Y C Katoch for the accused/petitioner and Public Prosecutor Ravi Gupta for the State, Principal Sessions Judge observed, “the accused under the colour of his office is protector of the life and limb of the citizens of the State. The charas weighing 485 grams has been recovered from his custody. He is guardian of rights of the citizens of the State. This makes his lapse serious irrespective of the fact that the vigor of Section 37 NDPS Act does not apply to the fact of the case”.
“His duty as a man of belt force was to contain and control the cancer of drugs in the society which has diluted the mental order of young generation as such the crime alleged to have been committed by him is grave”, the Court further observed and dismissed the bail application.
