Court denies bail to cop in fake encounter case

Srinagar, June 2: A local court today dismissed the bail application of accused-cop involved in infamous Kokernag fake encounter in which a street vendor was killed in the year 2006.
Farooq Ahmad Guddu an ASI of J&K police of Ganderbal district has been found to be involved in the killing of a civilian and 3 FIRs were registered against him including other accused involved in the offence.
Principal District Judge Bandipora presided by Amit Sharma while rejecting the bail plea of the accused-Guddu on medical grounds said the accused persons involved in the FIRs are none other than the police officers. Court said they, under the garb of a police uniform such type of fake encounter was committed definitely shaken the basic faith and confidence of the common man in the working of police organization.
Court said the crime committed by the accused person became more severe simply because of this reason that the deceased killed in the encounter was actually the resident of the village of accused and was working as street vendor at Lal Chowk Srinagar where he was lifted by the police and kept in Manasbal SOG Camp.
“Meaning thereby the concession of bail either on medical grounds or other grounds at this stage of the trial definitely shakes the spine of the common man in the present dispensation of criminal justice. Hence the medical bail application moved by the accused is rejected”, Court concluded.
Court on contentions of the accused that he is suffering ailment said, that can be managed under the supervision and control of the concerned superintendent jail from the specialized hospital of the district where the accused is presently lying in judicial lockup.
