JAMMU, Apr 20: Principal Sessions Judge Jammu Kartar Singh has rejected the bail application of one Shanker Kumar, who was facing trial for committing murder of his wife.
According to the prosecution case, on July 8, 2010, Pooja Devi was admitted in Government Medical College, Jammu and in her statement she told the police that she was set-ablaze by her husband. On the statement of the deceased, case for the commission of offence falling under Section 307 RPC was registered against the accused. Ultimately, the deceased succumbed to the injuries and offence under Section 302 RPC was added.
After hearing both the sides, Principal Sessions Judge observed, “in support of charge, prosecution has examined nine out of 20 witnesses. A perusal of the statements of the witnesses examined by the prosecution reveals that there is prima facie evidence against the petitioner in order to believe that he has committed the alleged offence”.
“The case of the prosecution is based on dying declaration and some of the witnesses are yet to be examined. In view of such circumstance on record, the petitioner has not been found entitled to the concession of bail, as the alleged offence is punishable either death or imprisonment for life”, the court observed and rejected the bail application.
