Court denies bail to self-styled DFO

JAMMU, Sept 13: Principal Sessions Judge Jammu, Jang Bahadur Singh Jamwal today rejected the bail application of a self-styled DFO namely Mohd Yousaf Wani, son of Abdul Ahad Wani of Kunzar, Tangmarg, who was allegedly involved in making fake appointments and collecting heavy amounts from the complainant and her relatives.
According to the police case, a complainant on behalf of Sikander Hayat, Sikander Hussain, Mushtaq Hussain, Mohd Aksar, Mohd Azam and Mohd Alyas duly endorsed by Special Municipal Magistrate, Jammu was received in the Crime Branch for investigation.
In the complaint, it was alleged that the complainants came to know from a ‘religious leader’ namely Mohd Ashraf that one Mamta Devi, her husband Jasbir Singh, daughter Sonia and Neelam Devi, wife of Harnam Singh, who were having political links could manage Government jobs for the complainants.
Accordingly, the complainants approached these persons and made a payment of Rs 3 lakh each for job in the Social Forestry Department. On the date fixed by the accused persons, the complainants were handed over orders mentioning their appointment as Plantation Watchers in the Social Forestry Department. The accused persons also got published the select list in the newspaper.
During the course of Crime Branch investigation, Mamta Devi, who was also claiming to be a pious lady, lodged a written report mentioning that Mohd Yousuf Wani, self styled DFO, two other accused Mohd Qayoom Master and Manzoor Qadri, self styled Municipality Clerk and DFO respectively have duped various innocent people by giving them false promises and assurances that their wards will be appointed in the Government jobs but nothing of that sort has matured till date.
On the basis of this report, police registered a case under Sections 420/467/468 RPC and commenced the investigation.
After hearing Advocate Monika Kohli appearing for the accused-petitioner and Choudhary Shabir Ahmed, Public Prosecutor for the State and after scanning of both the CD files, Principal Sessions Judge, Jang Bahadur Singh Jamwal observed, “the investigation is at the infancy stage. In such like circumstances, it will not be appropriate to interfere and grant bail to the petitioner/accused when he has duped lot of people and has issued forged engagement orders of Plantation Watchers in Social Forestry Department”.
“The act of the petitioner/accused is scandalous. Such kinds of rackets are prevalent in the country and in J&K also where the unemployment is at large. Every youth of the State for the sake of employment is prepared to be duped by such kind of racketeers”, the Court said, adding “if such type of cases are not dealt with heavy hands and deterrence is not extended, there is every likelihood of such persons getting encouraged”.
“Though the offence committed by the petitioner is neither punishable with death penalty nor imprisonment for life but at the same time the punishment provided is extendable up to life and is non-bailable. The petitioner as a matter of right is not entitled to bail”, the Court further said, adding “there is apprehension and possibility that the petitioner will not turn to the investigation/trial in case the bail is granted to him”.
With these observations, Court rejected the bail application.
