Court denies pre-arrest bail in attempt to murder case

JAMMU, Aug 7: Principal Sessions Judge Jammu, Jang Bhadur Singh Jamwal today rejected the pre-arrest bail application of Sukh Dev Singh, son of Yoge Raj of Alora, who was allegedly involved in attempt to murder case.
According to the police case, one Shamsher Singh was brutally stabbed by the petitioner along with other accused persons at Nikki Tawi Bridge on June 13, 2012. Police, in its report, has held the petitioner as main accused in the case and mentioned that he (petitioner) was still at large.
After hearing Advocate S S Jamwal appearing for the petitioner whereas Public Prosecutor Shabir Choudhary for the State, Principal Sessions Judge, Jammu, Jang Bhadur observed, “scanning of the case diary as well as the police report has emanated that the petitioner after the commission of such a heinous offence is at large and is seeking protection of pre-arrest bail”.
“The injured is still under treatment and is fighting for the life.  The weapons of offences are yet to be recovered from the petitioner and in case, the pre-arrest bail is granted to him, there is likelihood that the weapons of offences may not be recovered”, the Court said, adding “the offence committed though is not punishable with death or imprisonment for life but that is not only the criteria for grant of bail”.
“The offence committed is punishable up to life imprisonment. In such circumstances, the custodial interrogation of the petitioner is required”, the Court said while rejecting the pre-arrest bail application.
