Court directs DC Jammu to attach movable property of school

JAMMU, Aug 14: Chief Judicial Magistrate Jammu Amarjeet Singh Langeh today directed Deputy Commissioner Jammu to attach movable property of Delhi Public School (DPS) to the tune of amount awarded in the award under execution and submit compliance report by or before next date of hearing.
However, court clarified that in case respondents deposit an amount of Rs 1,80,000 during execution of attachment warrant in question, District Collector (Deputy Commissioner) Jammu shall cause that amount to be received and deposited in this court for onward disbursement to the petitioners.
The order has been passed in an execution of award dated 24.06.2019 passed by Assistant Labour Commissioner Jammu in which the petitioners seek execution of award dated 24.06.2019 passed by authority under the Payment of Wages Act (by virtue of which petitioners were held entitled to claim of Rs. 1,80,000 under the Payment of Wages Act.
Accordingly, respondent was directed to deposit the amount within 30 days before the authority for its disbursement to the claimants. When respondent failed to deposit the amount with the authority concerned, an execution petition was filed under Section 15(5) of the Act by the authority concerned on 10.10.2019.
