Srinagar, Nov 20: The Jammu and Kashmir High Court today directed the Deputy Commissioner Srinagar to implement the court order and not make deliberations regarding action to be taken against hoteliers who are violating the pollution norms.
The Division bench of the State High Court comprising Justice Mohammad Yaqoob Mir and Justice Muzaffar Hussain Attar while hearing a petition regarding protection and preservation of the famous ski resort of Gulmarg today directed Deputy Commissioner, Srinagar, Farooq Ahmad Shah, to file better affidavit and compliance report with regard to the implementation of court order on taking action against the erring hoteliers.
The Court observed that the DC’s compliance report is not in tune with the directions of the court. During the argument, the counsel for the petitioners observed that it seems the DC has made a court in his own chamber.
In his status report filed by the DC to the Jammu and Kashmir High Court, Shah has said that he invited all the representatives of the hoteliers to his chamber and during threadbare deliberations they were informed about the court orders.
Taking serious view of the DC’s status report, the court observed: “He has to get the court order implemented and not to make deliberations.”
The court further observed: “Conduct of the DC seems that he has convened a Panchayat.” His counsel and Senior Additional Advocate General J A Kawoosa was told: “Don’t justify this is implementation.”
The court directed that commercial activities of the erring hotels should be immediately stopped after the issuances of notices to them.
The court observed that there are no indications as how the court orders are to be implemented without any loss of time and directed the DC to take help from Director General of Jammu and Kashmir Police.
The court extended the time for examining the functioning of the STPs of those hotels who have installed the STPs and lifting of samples for testing and whether these STPs are showing efficiency or not.
