Court directs GDA for allotment of shops to dislocated shopkeepers

Srinagar, Nov 7: As the authorities have informed the court about the availability of shops in Gulmarg tourist resort, High Court has directed to allot the same to the dislocated shopkeepers with the compliance before the court by tomorrow.
The Division Bench of Justice Atul Sreedharan and Justice Javed Iqbal Wani directed the Chief Executive Officer, Gulmarg Development Authority, Gulmarg to allot the a shops to the aggrieved shopkeepers with an affidavit before the court showing therein that the court orders have been complied with.
CEO-Gulmarg Development Authority, Gulmarg appeared before the court and had informed that there are shops available and are lying vacant and unoccupied. “Under the circumstances, the same shall be allotted to the petitioners within seven days and file an affidavit to that extent before this court, showing compliance. List on 08.11.2023, at the top of the list. The Chief Executive Officer, shall remain present in person before this Court on the next date of hearing”, DB directed.
Noted to be here that the GDA authorities are under contempt proceeding as the basic judgment has not been complied with which forced the aggrieved shopkeepers to filed contempt proceedings before the court in order to get the court verdict implemented.
The compliance report of the Chief Executive Officer, Gulmarg Development Authority reveals that action in the matter with regard to the rehabilitation of the affected shopkeepers has to be undertaken by the Government.
The shops of aggrieved persons were dislocated by the GDA for beautification of resort way back in 1999 and some of them were rehabilitated leaving the aggrieved shopkeepers behind which compelled them to approach the portals of the court to seek the rehabilitation on the analogy as has been done with the case of other dislocated shopkeepers.
