Court directs SVO to register FIR against Patwari, others

JAMMU, Jan 9: Special Judge Anticorruption Jammu, Sanjay Dhar today directed the State Vigilance Organization to register FIR against Patwari and others The direction was passed in a complaint filed by one Ram Rattan. The complainant had purchased land measuring 2 kanal and 7 marlas in Khanpur Nagrota from Rakesh Magotra, who along with his father had earlier purchased the land from Om Parkash. Om Parkash had acquired the ownership of the land by virtue of mutation attested in his favour under Sections 4 and 8 of Agrarian Reform Act. According to the complainant, the revenue officials while issuing Fard Intikhab in respect of land in question at the time of sale on two occasions repeatedly concealed the fact that land in question had been acquired by Om Parkash under the provisions of Section 4 & 8 of Agrarian Reform Act. He further submitted that he was being threatened of dispossession by the successors of Om Parkash. During the course of verification, it came to fore that the Fards for first sale deed in respect of the land have been prepared by Shallo Ram and same have been attested by Shanti Saroop, the then Tehsildar Jammu without obtaining permission from the competent authority. However, the Vigilance Organization refused to lodge FIR on the ground that the matter was of civil nature. After going through the complaint and outcome of verification, Special Judge Anticorruption Sanjay Dhar observed, “this court is not impressed by the submission of the prosecution. It is true that civil litigation between the applicant and the successors of Om Parkash is pending before different fora but it is also a fact that there is material on record which goes on to show that important facts have been concealed by the revenue officers”. With these observations, court directed Vigilance Organization to register a case and proceed with the investigation.
