Court discharges kidnapping accused as police fails to complete investigation

JAMMU, Dec 15: Principal Sessions Judge Poonch, Jaffer Hussain Beigh today discharged three alleged accused namely Jaswant Singh, Manmohan Singh and Gurvinder Singh, who were challaned by the police in kindapping case and directed police to investigate the matter again.
“Incomplete challan has been presented against the accused persons before the court of District Mobile Magistrate Poonch on 29.4.2014 in FIR No.42/2012 for offence under Sections 366 and 109 RPC. The Investigating Officer during the course of investigation has recorded the statement of the witnesses conversant with the facts and has also got recorded the statement of the witnesses under Section 164-A CrPC”, Principal Sessions Judge said.
“Without completion of the investigation and without recovery of the prosecutrix the challan has been produced against the accused for kidnapping of the prosecutrix. Unless and until the complete challan is not produced before the court and till the recovery of the prosecutrix and her statement is not recorded it is not possible to frame charge against the accused persons”, the court said.
Accordingly, Court directed Public Prosecutor to get the investigation of the case completed in all respects within a period of three months and complete investigation report be produced before the court of law. With this direction, court discharged the accused persons.
