Court frames charges against SHO, others in bribe case

JAMMU, June 14: Additional Sessions Judge Anticorruption Doda Amarjeet Singh Langeh has framed charges against Ghulam Nabi Mir, the then SHO Gandoh and Ghulam Nabi Bhat, Head Constable and Nek Singh, constable in bribe case.
According to VOJ (Now ACB), a complaint was lodged on 10.07.2013 alleging that the then SHO Police Station Gandoh and the then Head Constable demanded bribe of Rs 12000 for lodging an FIR in connection with molestation case of complainant’s daughter-in-law.
During the course of investigation, a trap was laid inside a hotel near main gate of Police station Gandoh wherein Head Constable (Munshi) was caught red handed while accepting gratification of Rs 7000 from the complainant. However, SHO who also demanded share in the bribe to the tune of Rs 1000, gave a slip to trap laying team.
On the conclusion of investigation, commission of offences under Sections 5(1)(d) read with 5(2) of J&K PC Act and Section 4-A of J&K PC Act (Amendment) 2014 and 201, 120-B of RPC was established against accused and chargesheet was presented .
After hearing both the sides, the court observed, “there is prima facie material available on record to frame charges against accused for offences under sections 5(1)(d) r/w 5(2) of J&K PC Act Svt 2006 and Section 4-A of J&K P.C Act (Amendment) 2014 and Sections 201and 120-B of RPC. Accused are accordingly charge-sheeted for these offences”.
