Court frames charges in DA case

JAMMU, June 7: Additional Sessions Judge Anticorruption Doda Amarjeet Singh Langeh has framed charges against Jugal Kishore, store-keeper in CAPD, in disproportionate assets case.
The allegations in the chargesheet are that based on an  open verification, it came to fore that accused by indulging in illegal and corrupt practices – accumulated huge assets beyond his known sources of income as storekeeper in department of CA and PD in Ramban-Gool.
After preliminary verification, FIR No 26/2011 for offences under Section 5 (1) (e) read with Section  5 (2) J&K Prevention of Corruption Act was registered and investigation started. On the conclusion of investigation, it was established that as a storekeeper accused accumulated disproportionate assets in the form of movable and immovable property.
The immovable property acquired by accused comprised of double storied residential house at Kuleed in Kishtwar, single storey residential house in Roopnagar Enclave built on 10 Marlas of land, 43 Kanals of land at Dool, Kishtwar, one plot measuring 13 Marlas at Mohalla Kuleed.
The movable properties acquired by accused as per investigation  which are disproportionate to his known  and legal source of income, included household items like furniture, jewellery (40 Tolas of Gold), different types of vehicles, one revolver, one Single Barrel Gun, one  NP Bore Rifle, motorcycles etc.
After hearing both the sides, court observed, “it is trite and perhaps needs no reiteration that at the stage of framing of charges in a criminal case, neither roving inquiry into the allegations can be embarked upon nor can an exercise to ascertain truthfulness, sufficiency and acceptability of material produced by investigating agency be undertaken”.
“All that which has to be taken into account at this stage is existence of prima facie evidence providing grounds for presuming that accused has committed offences as alleged. Rest of the exercise is in the domain of trial. In the case in hand, the material available on record prima facie establishes involvement of accused in the commission of offences”, court said.
Accordingly, court framed charges.
